Ducktrap Mother’s Day Giveaway Official Rules

ALL DISPUTES WILL BE RESOLVED SOLELY BY BINDING ARBITRATION, AND ENTRANTS WAIVE THE ABILITY TO BRING CLAIMS IN A CLASS ACTION FORMAT.

AGREEMENT TO RULES:

By participating, you agree to be fully and unconditionally bound by these Official Rules (“Rules”), and you represent and warrant that you meet the eligibility requirements set forth herein. Any violation of these Rules may, at Ducktrap River of Maine’s (“Ducktrap”) discretion, result in disqualification. You agree to accept all decisions of Ducktrap as final and binding in all respects as they relate to this Giveaway.

Eligibility:

The Ducktrap Mother’s Day Giveaway (“Giveaway”) is open to all individuals who enter via Instagram and meet the following criteria:

• Must be 18 years of age or older as of the date of entry.
• Must be a legal resident of the United States with a valid U.S. mailing address.

Employees of Ducktrap River of Maine, its affiliates, subsidiaries, advertising and promotion agencies, and their immediate family members or household residents are not eligible to enter. This Giveaway is subject to all applicable federal, state, and local laws and regulations and is void where prohibited.

Sweepstakes Entry Period:

Entries will be accepted starting April 23, 2025, at 11:00 AM EST and ending May 2, 2025, at 11:59 PM EST (the “Giveaway Period”).

How to Enter:

To enter, visit Ducktrap’s Instagram (@ducktrapriverofmaine) during the Giveaway Period and complete the following steps:

• Follow @ducktrapriverofmaine on Instagram.
• Like this post.
• Share the official Giveaway post to your Instagram Story and tag us.
• Comment MOM 
• Bonus Entry: Tag a mom or someone who deserves a treat.

Each entry must comply with Instagram’s Terms of Service. Incomplete or non-compliant entries may be disqualified at Ducktrap’s sole discretion.

Prizes & Approximate Retail Value (ARV):

TEN (10) winners will each receive a package featuring Ducktrap smoked seafood variety and a charcuterie board. The approximate retail value (ARV) of each prize is $75. No cash or other prize substitution is permitted. Prizes are non-transferable. All prize-related expenses, including federal, state, and local taxes, are the sole responsibility of the winner.

Winner Selection & Notification:

Winners will be randomly selected from all eligible entries received during the Giveaway Period. The drawing will be conducted within seventy-two (72) hours after the Giveaway ends. Winners will be notified via Instagram direct message on May 5, 2025.

Ducktrap is not responsible for any winner’s failure to receive notification due to privacy settings or incorrect contact information. If a selected winner cannot be contacted, is ineligible, or fails to claim the prize within seventy-two (72) hours of notification, the prize may be forfeited, and an alternate winner will be selected.

General Conditions & Release:

By entering this Giveaway, entrants agree to:

1. Be bound by these Official Rules and Ducktrap’s decisions.
2. Release Ducktrap and its affiliates, employees, and agents from any liability arising from participation in the Giveaway or the acceptance, use, or misuse of any prize.

Ducktrap is not responsible for lost, late, misdirected, or damaged entries.

Legal Warning:

• Any attempt to deliberately damage, destroy, tamper with, or vandalize this Giveaway or affiliated Instagram account and interfere with the operation of this Giveaway is a violation of criminal and civil laws. Ducktrap reserves the right to seek damages and pursue all remedies against any such individual to the fullest extent permitted by law.
• Governing Law & Dispute Resolution:
• Any controversy or claim arising out of or relating to this Giveaway shall be governed by and construed in accordance with the substantive laws of the State of Maine without regard to its conflict of law principles. Any disputes shall be submitted to final and binding arbitration held in Waldo County, Maine, before a single arbitrator selected by mutual agreement of Ducktrap and the entrant. The arbitration shall be a confidential proceeding closed to the general public.
• Entrants agree that any claims will be resolved individually and exclusively through arbitration, without resort to any form of class action. Entrants further agree that any award in such arbitration shall be limited to actual out-of-pocket costs incurred in connection with participation in the Giveaway.
• Privacy:
• By entering this Giveaway, you agree that Ducktrap River of Maine may use the personal information provided through your entry in accordance with its privacy policy.
• Sponsor:

• No Implied Endorsement:
• This Giveaway is in no way sponsored, endorsed, or administered by, or associated with, Instagram or Facebook. By entering, you release Instagram, Facebook, and their affiliates from any liability related to this Giveaway.
